USER TERMS & CONDITIONS
By payment or by accessing or using software provided by Homesearch, you acknowledge that you have read, understood, and agree to be bound by these Terms.

Homesearch Digital Ltd (hereinafter referred to as “Provider”or “Homesearch”), a company registered under the laws of England and Wales, with its registered address at 14th Floor 33 Cavendish Square, London, England, W1G 0PW. Company Number: 11719538
And
The Subscriber
Hereinafter referred to as ” Subscriber”, an individual or entity entering into this Agreement
1. Service Description
Access to Enhanced Insights Reports (UK Residential Property Data Reports) delivered through your Customer relationship management platform (CRM)
2. Subscription Term
The term of this Agreement is initially set for 1-month from the date of accepting and 1st payment, unless terminated earlier or payment ceases. Upon the conclusion of the initial term, this Agreement will automatically renew for an additional 1-month period indefinitely, unless terminated or payment ceases. Homesearch reserves the right to adjust the monthly subscription cost by the greater of RPI (Retail Price Index) or 4% once in a 12 month period, by giving 30 days notice or by any other amount giving 60 days notice.
3. Cancellation
Subscriber can cancel the agreement at any time by contacting [email protected] or by ceasing payment of the monthly subscription amount. Access to the Enhanced Insights reports will immediately cease when cancelled.
4. Order, Fees and Payment
Subscriber shall pay the fees for the Service as specified on the Order
The Fee shall be paid monthly with the first instalment becoming due immediately unless otherwise stated. The price quoted is exclusive of VAT
5. Governing Law and Jurisdiction
This Agreement shall be governed by and construed in accordance with the laws of England and Wales. Any dispute arising out of or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts of England and Wales.
6. Data Privacy and Confidentiality
Homesearch acknowledges that subscriber’s data is confidential and agrees not to disclose it to any third party. The Provider shall take reasonable measures to ensure the security and confidentiality of Subscriber’s data. Both parties agree to comply with all applicable data protection laws and regulations. We will only use your personal information to go about improving our Services, including testing, research, internal analytics and product development.
7. Intellectual Property
Subscriber acknowledges that all intellectual property rights in the Service and any materials provided by the Provider are owned by the Provider. Subscriber shall not use the Service for any purpose other than as permitted under this Agreement.
8. Limitation of Liability
In no event shall the Provider be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with this Agreement, whether or not the Provider has been advised of the possibility of such damages.
9. System Downtime, Problem reporting and Response Time
The Provider shall make reasonable efforts to ensure the availability of the Service at all times, excluding scheduled maintenance periods. In the event of unscheduled system downtime that prevents Subscriber from accessing the Service for more than 48 hours, the Provider shall notify Subscriber promptly and use reasonable efforts to restore the Service within a reasonable timeframe. The Provider shall not be liable for any damages or losses arising from Homesarch system downtime or your CRM system downtime
The Provider shall use reasonable efforts to respond to any support requests or inquiries from Subscriber within 48 hours during regular business hours, excluding weekends and holidays.
The Provider shall use reasonable efforts to resolve any service disruptions or issues reported by Subscriber within 72 hours during regular business hours, excluding weekends and holidays.
In the event that the CRM no longer provides access to this service through their platform the Provider will advise the Subscriber via email giving 60 days notice and providing an alternative solution to Subscriber. If an alternative solution is provided this will form a new agreement.
10. Fair Use:
Homesearch reserves the right to monitor usage patterns and take appropriate action if usage is deemed excessive, abusive, or inconsistent with the subscription pricing. Excessive use may include, but is not limited to, unusually high consumption, excessive storage usage, or any activity that negatively impacts the performance of Homesearch for other users.
In the event of a violation of the fair use policy, Homesearch reserves the right to limit, suspend, or terminate access to the Enhanced Insights Reports without prior notice. Homesearch will make reasonable efforts to communicate with the user and resolve any issues before taking such action.
You agree not to attempt to reverse compile, disassemble, reverse engineer, or otherwise extract the Software’s code. You also agree not to access the Service to develop a competing product, provide the Service to third parties, or commercially exploit the Service in any way without authorisation. Finally, you agree not to assist others in gaining unauthorised access to the Service.
