TERMS & CONDITIONS
By signing the contract or by accessing or using software provided by HomeSearch, you acknowledge that you have read, understood, and agree to be bound by these Terms.
1. Data Privacy and Confidentiality
HomeSearch acknowledges that subscriber’s data is confidential and agrees not to disclose it to any third party. The Provider shall take reasonable measures to ensure the security and confidentiality of Subscriber’s data. Both parties agree to comply with all applicable data protection laws and regulations. We will only use your personal information to go about improving our Services, including testing, research, internal analytics and product development.
2. Intellectual Property
Subscriber acknowledges that all intellectual property rights in the Service and any materials provided by the Provider are owned by the Provider. Subscriber shall not use the Service for any purpose other than as permitted under this Agreement.
3. Free Trial Period
If the Subscriber has entered into a Free Trial Period the Subscriber may use the Service without any charge within the agreed period. If Subscriber decides to terminate the Service during the trial period, no charges shall apply.
HomeSearch will provide access during the period of the trial but withholds the right to Terminate services at any time.
4. Limitation of Liability:
In no event shall the Provider be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with this Agreement, whether or not the Provider has been advised of the possibility of such damages.
5. System Downtime, Problem reporting and Response Time
The Provider shall make reasonable efforts to ensure the availability of the Service at all times, excluding scheduled maintenance periods. In the event of unscheduled system downtime that prevents Subscriber from accessing the Service for more than 48 hours, the Provider shall notify Subscriber promptly and use reasonable efforts to restore the Service within a reasonable timeframe. The Provider shall not be liable for any damages or losses arising from system downtime.
The Provider shall use reasonable efforts to respond to any support requests or inquiries from Subscriber within 48 hours during regular business hours, excluding weekends and holidays.
The Provider shall use reasonable efforts to resolve any service disruptions or issues reported by Subscriber within 72 hours during regular business hours, excluding weekends and holidays.
6. Fair Use
HomeSearch reserves the right to monitor usage patterns and take appropriate action if usage is deemed excessive, abusive, or inconsistent with the extra branches and agreed pricing sections of this quote. Excessive use may include, but is not limited to, unusually high consumption, excessive storage usage, or any activity that negatively impacts the performance of Re:Contact for other users.
In the event of a violation of the fair use policy, HomeSearch reserves the right to limit, suspend, or terminate access to Re:Contact without prior notice. HomeSearch will make reasonable efforts to communicate with the user and resolve any issues before taking such action.
You agree not to copy, modify, duplicate, or create derivative works from the Software in any form or media, or by any means. Additionally, you agree not to attempt to reverse compile, disassemble, reverse engineer, or otherwise extract the Software’s code. You also agree not to access the Service to develop a competing product, provide the Service to third parties, or commercially exploit the Service in any way without authorisation. Finally, you agree not to assist others in gaining unauthorised access to the Service.
